on tuesday morning i recieved a call from my sister telling me my father was diagnosed with cancer of the pancreas, she was hysterical as was i. I called my place of employment to let them know i would not be in that day as my father was in a hospital with cancer and i needed to be with my family . i left as i had a 5 hour drive to be there. i called my dentist office the next morning to let them know that i was sorry i didn't make my 8 am appointment. the dentist office asked me if i worked at my place of employment anymore as they had called there for me and were told i didn't work there anymore. I was floored to say the least she had fired me and told everyone else and hadn't even told me yet. I am still stunned and really don't even know what to think . this woman is evil

Employment At Will or Not... I think what has happened to you might be illegal! Not sure if you are in Florida, as the previous quote has referenced, but I'd contact your State agency www.eeoc.gov for some advice and help. I am almost certain you were protected by a law during that situation! Please look into this, employers like this need to be stopped! We work to live, we don't live to work!

I suggest that you check out your (ex?)employer's policies. One would think that despite at-will employment, if they violated their own policies in discharging you, they're liable to you for *some*thing.

Hang on a second... Didn't we pass the Family Medical Leave Act (FMLA) and isn't that now Federal Law? You got 'em. But call 'em first to be sure of the facts. Then go get em. You win hands down! Sorry to hear about your dad.

I think you have a reason to get back at them about firing you - especially with the Family Medical Leave Act. Also, I would check with the EEOC office in your area. I think the states who adopted the at will act stink! I'm so sorry to hear about your dad.

Family Leave Act covers you. Talk to your state attorney general's office, freshen up your resume, get what's coming to you and get out!

Good point about the FMLA! And I too, am very sorry to hear about your dad and sorry you got treated this way during a hard time. How embarrassing to hear it from your dentist!! Sheesh. In reading the comments above, it is nice to see that there are people who care and we can support you from here, spudsans. =)

Thank you all for your concern i would have responded earlier but i have been pounding the pavement, I also have to leave for Minnesota as my father is having surgery. I am not eligible for fmla as i have not been employed by this company for 12 months. I still am stunned by this, but when one door closes another one is sure to open. I shouldn't even complain at least i do have a roof over my head unlike the people of Louisiana.

Have you received an official notification of your termination? I ask because if you took the word of the dentist's office (shocking) and did not return, you may be listed as a voluntary resignation. Also, be sure to pursue your unemployment rights, because the employer must provide an official reason for your termination - especially if they chose to "fight it". I would really be interested in learning how this turned out!

I did call and was told that i was fired. I applied for unemployment also not sure if i qualify haven't heard yet. I also called H.R. of this company they called me back after investigating and agreed that i was wrongfully terminated. They offered me a job at a different location but i havent heard anymore thus far as they were to call me back with the offer. The problem is the location they are looking for a postion is 5 hours away. I hope they offer to pay for me to move . lol what a big joke. At least I know now how wrong she was what a jerk.

Use that as leverage to get a job at your current location (no five hour move) or they will be getting a visit from your lawyer to discuss the pain and suffering inflicted upon you by your ex-bosses insensitiveness... They are trying to make you go away by offering this job that is five hours away. If you decline then they can say "well..we tried!" Contact a lawyer, you've got a good case.

A co-worker of mine was disciplined for leaving work to go to the doctor. She had to have someone drive her to the doctor because her blood pressure was so high she couldn't see well. Is that illegal? I think they were trying to kill her. Or at least harass her into quitting (which she did) because she is over 50, they can replace her with someone just out of college, and they don't want to pay her health insurance. Georgia also is a "right-to-work" state, meaning right to fire you for no good reason.

Doesn't this company you worked for have any personal days for family situations? I know where I'm at we're allowed three family days a year, for just the kind of stuff that's happening to you now. Have you missed a lot of days and/or been late to work a lot? That could be the reason they let you go. I would check the company handbook to see what it says about your situation -- also, contact the Better Business Bureau and report them for unfair business practices. I don't think there is really much else you can do about it, though. There is at-will employment in Florida, which basically means that employers don't really need much of a reason to end a working relationship. It is at-will for both parties concerned. The lady who did this to you is pretty heartless. She would probably be very successful at the company that I'm at.
