Okay, in my employee handbook it says that all absences must be reported before 10am of that working day, if not sooner or it is grounds for being fired. I called in sick on Wed and Thurs - no problem. However when Friday rolled around it turns out that I ended up being emitted to the ER at 6am and didn't get discharged until after 5. Without any access to phone or email I had no way of communicating my absence - and with good reason. Bottom line, I didn't communicate until about 9:45pm. Do you think they can fire me if I have papers with hospitalization times showing I was preoccupied???

You're all right. Something like that doesn't happen every day. They've got to understand, especially, since you were out two days prior because of your condition.

While "no company in their right mind would" fire you, there is no guarentee they are in their right mind. Given our toothless labour laws, any old reason - or no reason - is sufficient to fire anyone at any time.

If they even breathe wrong about this, you'll have grounds for suit. Even if you work in a "Right to Work" state.

If you were hired "at will"? The company could fire you. Unionize or find a union job. Why? Something as assinine as being fired for being sick? Would NEVER happen! Yea, unions work!

They have no case whatsoever. If they even think that direction, you have a serious case against them.

UPDATE: So far nobody seems to have a problem with the fact that "I didn't call", but in my in box I had a few emails that said "and considering we didn't hear from you today, I assume you'll be in on Monday it won't be a problem for you to get this done by the AM". Most everyone is cool with it, there are always 1 or 2 thorns though...
