Can't take it anymore

I have been employed at a transportation place since April. The guy who trained me wanted to date, but I said no. He never showers and I take over the vehicle he gets out of, smells bad, and due to the nature of the work I do, the passengers look at me, like did you take a shower today? If you know what I mean. Doesn't stop there, he started putting his hands in places on me that I don't care to mention. Suppose to be a o percent tolerancy for that kind of stuff. I turned it in, nothing was done even though there was a witness. When the president of the company came for a visit, I told him how the situation got out of hand. He said he had to turn it in to human relations, and the bosses who didn't turn it in, would be dealt with, if they find out I am telling the truth. My hours have suffered, not to mention my self esteem. This guy told me he would never be fired, as he has too much on the boss. Now, I would like to know how I am suppose to work, knowing they are going to investigate, and my boss will be mad at me, for telling the president of the company. I would like to know if there is anybody that could shed some light on the subject.

First of all, document every conversation with this fat lazy slob. Wear a personal recording device, when he touches you inappropriately, state loud and clear to cease and remove his hands from said place. If he does not comply, you can resort to physical means to remove him from you, i.e. mace or pepper spray, then call 911 and report an assault. If this transportation company will not ensure safe environment for all of their employees, the law will. However, you have to have documentation and you can not lead this man on to get it. I hope this works out for you. Remember to not be a victim, be proactive and in his face about inappropriate behaviours and the consequences it will bring to him.

Don't know about you, but I'm tired of waiting for someone to make everything all right. Spray the rat!

Seriously, he is a pig. What is happening here is NOT O.K. Let me repeat, for emphasis, it is NOT O.K.! Get an MP3 player, some kind of digital recording device, and RECORD him. (Don't tell him-it is O.K. in most states-check on the internet for the laws.) THEN, you have a lawsuit. Do it for all of us...Good luck!

I wanted to do an update on the one I previously submitted. The Human Relations for that company came in and investigated the case, and after about 5 mins, she stated I was being too vague about the situation. No, gave a written statement about 10 pages long. Now, my position has been promised to somebody else, but I still maintain that I told the truth. The site supervisor is happy that it didn't go anywhere, and now looks at me, like I am the scum of the earth. Please remember this guy said he had something on the boss and never would be fired. I was up late on the internet reading mistakes a person makes when making a complaint. The one topic was when human relations for the company investigates the claim. They are working for the company, and they will investigate to the advantage of the company. I have done everything in my power to make sure that I told everything that happened, and now I was too vague. In short, this guy got by with touching of the breast, arm, leg, and when asked well, why do you think he would do that to you? I don't know, why did he think he could touch a 12 year old girl, and get by with it? He never showers, most crews don't want to ride with him, and yes, now I believe that he did have something on the boss. Why else would he be allowed to stay? If it enters into your head that I might be telling lies, well, that is not the case. I even went to see a counselor, couldn't take anymore, and she asked me, do you really think you are being vague about the situation? You sound very direct to me, she said. She also stated for 6.50 per hour, I would leave that place. Bottom line being, I educated myself too late on the Human Relations thing, I thought they would work to fix the problem. Not likely, they are now working on the end of my employment, making the job so rough that I am going to walk away.

Are you indeed a 12-year-old girl? I don't know what state you work in, but in many that would be seriously against child labor laws. Grab your last pay stub and your birth certificate and REPORT it to the Division of Labor.

starfire(11/10/2006)
No, I am not the 12 year old girl, this is the things he has bragged about getting by with, what he told me reasons why he will not be let go. Anyways, I have decided that I can tell the truth, but it doesn't matter. I asked the boss when he said well, what would make him think he could do that, I replied what would make him think he could touch a 12 year old girl and get by with it? You would have to see the whole picture to know what I am dealing with. I know my only resolution is to get another job, or to keep putting up with the situation. I am not willing to do that.

This really furiates me that a man would put his hands on a woman who has specifically told him NO and you reported to the HR Dept. and they are not helping you. I spoke with a law enforcement official about SPRAYING this rat and he advised that since you have reported the event - GO AHEAD AND SPRAY THE RAT. It sounds as though he has committed somer very serious offenses in the past and each and every time has been given the green light to continue. What do you think the RAT would do if someone put their hands on him after he said NO; xxououifiihjis!

Oops! Sorry for the typos, just had a cosmo.

starfire(11/11/2006)
Your comments are fine, and I do appreciate the advice. I would like to hear from you again, so please type something that might help me to gain perspective on why the one who told the truth is the bad one. I just don't understand what that is. Thanks to all of you who has typed a response.

WalkingInMyOwnShoes(11/11/2006)
"Adults" will be... well adults. I am worried about a lowlife who thinks he is secure enough to touch twelve year olds with impunity. If nothing else it is time to ask a local women's helpline such as a rape hot line how to proceed in your neck of the woods. I would have talked to a friendly police sergeant about Mr. Filth's statements about touching a child. The EEOC can give you some answers about sexual discrimination and filing charges. I am not a lawyer but by making these statements he made you and other coworkers accessories after the fact.

blola(11/11/2006)
Starfire, you are not the bad one; you are the GOOD ONE. Without you even knowing it, you have most likely helped to save an innocent person by exposing this excuse for a human being. What you did takes courage and I commend you for helping all of us and for making us aware of our responsibilities. Please do not feel that you are alone because those in charge chose not to do the right thing because they are cowards and God help them if this demonic creature should touch one of their family members. We all stand behind you and you are my "shero." Hold your head high because you just made a difference in someone's life.

Corporate Ladder Rung: CIODharmadee(11/11/2006)
Start with the EEOC, and go from there. Evil continues to happen because good people continue to look the other way-but there are laws out there-and somebody will listen, if you keep trying. Not in your company, though, you have to go to an outside authority. HR is only there to COVER UP. This is sad but true.

starfire(11/12/2006)
Yes, I found out too late about the Human Relations. Guess I should have known that. I will continue with trying to get somebody to liste, but also putting in applications for other jobs. My site supervisor looks at me like I am scum, but that is just how it goes. Can't tell you the number of times I have cried, and all I can say is that I told the truth. I know there is always two sides to the coin, but just maybe no justice is going to happen. I can't change the minds of the people who I work with, but I can change myself, and move on. Like I have expressed several times, I am very appreciative of all the helpful posts, and will turn it in to EEOC, but now that Human Relations has investigated, according to the one site I logged onto, that will only give them the ammunition to cover the whole situation up. I can say until I am blue in the face that I didn't lie, and if it is not going to change, then I have to make the change. Not giving up on what I have said, just giving up on the entire company. Again, I would like to thank everybody for their comments, wouldn't know what to do without the help. It does help to talk about it, but foremost in my mind now, is moving on, and holding on to the fact until I get a different job, I am to put in my 8 hours and go home. They have given another guy my hours effective from when he comes back from his 30 days off for the Thanksgiving holiday. Just another point I don't understand, this guy hasn't been at the company as long as I have, but gets 30 days off for Thanksgiving. Anyways, I am not going to make a deal out of something not going to change. Thanks for all the advice, I am really very happy people really do care.
