UUGGHHH I AM SO ANGRY HEAVEN FORBID ANYONE CROSS MY PATH AT THIS MOMENT!!! As many of you know I am in an ugly legal battle WITH THE MOST EVIL OF EVIL WHO PORTRAY THEMSELVES TO BE CHRISTIANS! I can't wait till my case is over to tell you who the company is and STAY THE HELL AWAY FROM THEM!

Now I'm Going To VENT!!! As Confessor wrote in his blog 4/6 "Leaving A Legacy" you should leave your job in good terms. Well, as much as I agree with this unfortunately it isn't always possible especially if you decide to take legal action. Now let me tell you how STUPID MY FORMER EMPLOYER IS! When I first began interviewing I will be the first to admit I took a nose dive straight into the Atlantic Ocean. By my third interview I was back in the game. Two prospective employers definitely appeared they were interested in hiring me. The whole shabang of this is our benefits package, salary, when can you start? Great right? They ask me for my references. Well, obviously this company is on my resume since I had been with them for close to two years. Well, the companies never called me back. In fact, I followed up with one hiring manager. You know the whole "Good Morning. This is Jane Doe. We spoke two weeks ago and....." "Yeah, I know who you are what do you want." (????) "Well, I just wanted to ensure you received my references and if you were in need of any fur...." "Yes. It was received. You'll hear from us even if you DON'T get the job." Click. I'm blown away. This was the very same person who I had spoken to and actually joked with! Second interview: "Can you start next Monday?" "Sure!" "Great. We just need to confirm your dates of hire and my secretary will contact you by Friday." No phone call and this place didn't even return my calls. A week in a half ago I decide to have an investigative company run a background/screening test for me. Nothing is making sense. I just received the first half of the report about 30 minutes ago. Guess what?! Not only do I have the skill set of a 3 year old, but basically I am unable to establish friendships and will NEVER lend a helping hand! MEEE Not help! Are you kidding me???!!! This motherbleeper cost me my job with his lies to the CEO BUT THAT ISN'T ENOUGH!!! HE'S NOW BLACKBALLING ME!!! Screw her that she has a little kid and on her own! I SWEAR TO GOD IF IT WEREN'T BECAUSE I WAS A MOTHER HE WOULD REGRET THE DAY HE LAID EYES ON ME!!! You would think that all the legal trouble they are already in they now do this as well? HOW STUPID ARE YOU??? THIS IS THE MAN MR. CEO WHO YOU PUT IN CHARGE OF YOUR OPERATIONS YOU MORON!! Moral of the story? Be prepared for all of this BS if you decide to file suit against a former employer. I do sometimes wonder if I should have just signed the severance agreement, but that would have meant that bastard won. He not only got me fired with his lies, but I would have left quietly without causing a fuss. NO WAY!! I SWORE MANY YEARS AGO I WOULD NEVER EVER LET ANOTHER ABUSIVE BOSS GET AWAY WITH PUSHING ME OUT WITH NO CAUSE! The CEO should have known better. He knew the type of worker I was but he believed this MOTHER&*()^()*^()^ ARRGGGHHHHH I HOPE HE ROTS IN HELL!!! I have my nice big red onion, paper, pencil, etc... going to stick his name in the onion AND BURY HIM SO DEEP IN A CEMETARY GRAVE...When he wakes up that one morning his life is going to be more catastrophic than Tsunami!!!

First off, as I think you already know, it is illegal for a previous employer to badmouth you. They can only state the facts about your employment length, etc...

Secondly, make sure next time that you list a multiple contacts in various positions from that company that you know will speak well of you! That might keep the background investigator from looking for additional info...

But I do believe what they did was illegal... not positive... but I think so.

RVF, I am reading this and I want to beat the blank out of him too!!! I am unsure, but this sounds like slander and you can catch him at it and I think in NY it can be a prosecutable crime. I would scare him into acting right. The way I look at things is try to win legally first! Hopefully our justice system will get him and take the bast@rd down. Second I pray that karma will get him, you know what goes around will come around. However I have not seen this come to pass in most cases. So that leaves the third choice, take matters into your own hands. However most people have to much to lose to take this route. It seems so unfair and I would want revenge as well, the only thing I could tell you is to call him and pretend you are a lawyer investigating a crime committed against you and that he is the primary suspect. I would lead him to believe that he could be facing a 5-10 in the joint with a cell mate named Bubba, who likes to take bubble baths. There are legal forms of revenge that can not be prosecuted and most law enforcement officials would find quite amusing. Photoshop his picture in some compromising situations. Call his wife and pretend your a jilted lover with a serious case of VD. Research this man and find his weakness and attack. I am not saying to kill him or do anything illegal, just mess with his head. Send him a bouquet of flowers with poison ivy in it. It won't kill him but make him itch terribly. (this might be illegal)
Oh, maybe you should not listen to me. I lay awake at night dreaming up these ways to get even. I try to make them as PG as I can. I am not saying you should physically harm this man. He is set on destroying you however! I guess the best form of revenge would be to let him know that you got a new and better job and give him the number of your new employer and tell him to call them. Set up a cell phone number with the number you gave him and let him talk smack about you and see how far he goes. Record the conversation. Catch him at the slander. Or the next interview you have, you can say that your ex boss is suffering from a mental break down and is not stable enough to give a reference, and then use your employee performance reviews, which you should have a copy of for a reference. My thought is, he is obviously grasping at straws and will hang himself! I am sending you mojo today and every day until this is resolved for you. Best wishes.

OH MY GOD. I really feel for you. This is awful!

What part of the background check does this come up in? I wasn't aware that companies could leave notes about you in your "background" ---how does one go about doing that anyway???

DO NOT---I REPEAT--DO NOT go the eye for an eye mentality. That will start a vicious circle and will make you just as bad as him even though it would feel good.

Did you tell your lawyer about this? Seems he should know about it as soon as you are able to tell him calmly.

Freedom I have been in tears the majority of the morning. Your blog made me laugh so HARD I woke up my 3 year old. He walked into the living room asking "Mommy. You okay?" OMG I am still laughing! Thank you so so much. I thought I was twisted. Great to know there is someone who is worse than me hahahahaha THANK YOU!

Twiz. I too thought it was illegal. In my case it could be used as part of my retaliation claim under Title VII. Otherwise it isn't (at least not in NY.) Turns out unless you actually start a job or a job offer is made with an exact start date and verbally rescinded there is nothing illegal. A former employer can basically say anything about you. It would be illegal if they made false accusations about me (ie theft or violent.) I wish I could use someone else, but my position was HR Director/Acting COO. The reference would actually have to come from the CEO himself who is rarely ever at the company. From my understanding the demon has full control of the company and the CEO is rarely if ever there anymore. Not to say the CEO would give me a great recommendation either. That remains to be seen. It is this part of the report we are still waiting for.

Sheila. Yes. The first thing I did this morning was contact my attorneys office. I doubt the poor associate was even able to understand a word I said since I was quite incoherent. I forwarded to her the first part of the report and once the full report is complete they would advise me if I should continue my job search. The company who conducts these types of investigations is called Allison Taylor (www.allisontaylor.com). When I spoke to my attorney a couple of weeks ago with my suspicions I told him I was planning on using this company. Ironically, they too use this very same company for many of there cases so I was on the right track. I am doing the Executive Level check which is $99.00. So far it has proven to be worth every penny. No need to worry that I am going to wait for this demon in a dark alley. I was just venting. It would be interesting once this goes to mediation or court how much does the CEO knows. The lengths his little buddy has gone to hurt me. The ILLEGAL lengths that is. As the Associate stated to me this morning my case originally was picking at straws (he said/she said.) The retaliatory acts commmitted against me since I filed suit has only strengthened my original claims of abuse and sexual harassment.

As I said I will keep you updated and CAN'T WAIT for the day when I can finally tell you who these low lives are.

I am glad I could make you laugh! It is times like this that you need to laugh and connect with others. We could write a spoof about all the things I wish I could do to get even, but just thinking of them makes me feel better. I sincerely hope things work out for the best for you! better sooner than later.

Questioning if there is still a legal way to mess up his credit and when his whips out his restaurant credit card it cannot be accepted. The embarrassment would be priceless.

This fatherless turd does not care that you have a child to support. Unfortunately I met even female managers with children of the same mindset. Maybe it's their way of eliminating future competition.

Does voodoo work without the accursed knowing about it? Don't know much about this, but be careful that the spell does not bounce back. Plan carefully if you must. Don't hurt yourself and your loved ones.
Even if you only had accepted a settlement and left quietly, chances are he still would have blackb^lled you. Sometimes you just got to fight. Walking away will only make you feel better temporarily. Several years from now you will be glad you did instead of regretting that you didn't. Either way there is damage and fallout; at least you will have something to show for it.

Hahaha that was funny Anonymous (the credit card.) Yes, Voodoo works if done correctly and the person will never know it is you unless they too are involved in the dark arts. The unknowing basically think they are going through a rough patch. Main rule is never hurt the innocent that is when it will definitely come back to hurt you. I must agree with your statement about female managers. I have seen they are more often less sympathetic to women with children. I never ever understood this. Even pre child I always tried to be accomodating to employee's with families. I remember the hell my parents went through with 3 little ones (the last came 10 years later and we were close to pre-teen years.) Heck with them. They normally don't last in the workplace anyway.

And you are right Anonymous. I am sure I would have still been blackballed even if I had sign the agreement. That was the first thing that occurred to me at our little meeting where they were hoping I would sign and walk away. NOT. THEY MESSED WITH THE WRONG LATINA!

Red--why did you put them on your resume? Never should have done that, with all due respect. You could have covered the two years that you worked with them by being "unemployed" on a resume--say you were raising your child, had an ill parent, won the lotto and travelled, went back to school, volunteered...etc....

I do respect that you had the guts to put it down, sweet Red, but maybe you should not have. And I am always the one to probably do what you did. but maybe you should have a 2 year void in your resume covered by a lie for self-preservation. Self-preservation seems to bring about the lowering (or more) of one's ethics, morals, values, etc...but we all have to survive and though it sucks sometimes it requires...lying. Or as some see it--omission. :(

I had no choice Blue. After World Trade I held consulting gigs here and there. Would be a really large gap of no steady employment from September of 01 to the present. Very few companies want single mom's. Discrimination is still quite rampant in this area. I thought maybe they will not give a bad recommenation and at worst offer none but dates of employment, salary, and confirmation of the position I held. Again, how stupid can one be! I'm suing you! If it were me I would have immediately thought this is a set up. Why? Because this person is suing us and she has the guts to list us as a reference? Wouldn't have taken a rocket scientist to figure it out. I am very angry yes, but on a positive note they just gave me more ammunition. I'm not done. Just hired another investigative agency. I want a background check on this low life. If I can proof he was a bully at his last place of employment as well it should reinforce in court my verbal testimony.

Final report status from Allison Taylor is in. First let me say if you ever wanted to know what a former employer is saying about you I highly recommend this company and I've used investigative agencies in the past. This is by far the best I have ever used. In short, which is interesting they asked the demon if I was eligible for re-hire to which he responds "No." That there was an agreement between the owner and I to leave on my own recognizance. Here is the kicker. When they asked the demon if he could describe my strengths and weaknesses he replies he didn't really work with me. BUT, when they inquired if I had the ability to mentor, etc... He responds No. I wasn't performing at those strengths. Huh? You knucklehead! You say you didn't really work with me, but you are able to assess my mentoring and team building skills??? Papers sent to my attorney. Let's see what EEOC now says.
