26 years and they said "you"ll not get UEC

Me wife worked for same health care provider (scheduling) for 26 years. Sometime in Feb. 2011 they told her one more mistake and your fired. Memorial Day Friday she made some mistakes. She new it. 10 days ago, Sept. 18, she was called into HR and told she was fired for the Memorial Day friday mistakes. Also was told that they will fight UEC. My wife has since applied for UEC (haven't heard yet). I say we should get a lawyer and make them pay severance or something. Think we have a case?

Depending on what state you work in, if you are in the United States, you have different rules. If the state is at-will, it means they can fire you for no reason at all, no severance is required. You can research this with your local labor board website. I would definitely apply for Unemployment and fight to get it though. If you hire a lawyer, be sure to get one that takes his cut at the end of the case. Be prepared to have the company lie like rugs and do their best not to pay up.

Labtech is correct. If you are in Texas or Alabama in the USA? Workers have NO rights and can be canned for no reason without a moment's notice. AND? The management can have double standards at the workplace (i.e. different people/groups and different rules). But you SHOULD try to get your case heard by a legal professional. I wouldn't pay for legal assistance if you don't have to (pro bono employment lawyers) because you may not win. But if you can find a pro bono employment lawyer? GO FOR IT!!!! GOOD LUCK!!! Keep us all posted!!!

apply for unemployment anyway, unless a lawyer told you otherwise. some employers will not fight your claim because they cannot risk to be screened. others will fight and lie. do not get upset if HR claims no knowledge of your wife's existence or failing that will claim she left the job months ago, and all sorts of other accusations. even accusing you of having caused her injury. i stress again: do not get upset! don't argue with anyone least of all your wife, because that is the targeted outcome. some companies neglect to pay their share hoping they won't have to.

your wife's age and working years are the unfortunate tip-off. companies will use any excuse to fire long term loyal workers and hope not to pay for UEC. the department dispensing UEC should take the company's lay-offs and firing record into account. let's hope you have proof of everything per e-mail and/or in writing.

and r.g.k. your "worst job" certainly made me chuckle and agree.
